1. SELLER IDENTIFICATION

These Terms & Conditions of Sale (the “Terms”) apply to any sale of NFTs carried out by:

C-Elia : Unchained
Artist and Maison de Haute Meta Couture

(hereinafter referred to as “the Seller”)
 

2. PURPOSE

These Terms govern the sale of NFTs (Non-Fungible Tokens) representing original digital artworks created by C-Elia : Unchained.

NFTs may be offered:

• directly via the Seller’s website, and/or

• through third-party NFT platforms.
   

3. NATURE OF THE NFTs

Each NFT corresponds to:

• an original digital artwork,

• uniquely identified on a blockchain,

• associated with specific metadata (title, AIteration number, edition, etc.).

The purchase of an NFT does not constitute the purchase of the underlying artwork in a material sense, but the acquisition of a unique digital token associated with the artwork.
 

4. RIGHTS GRANTED TO THE BUYER

The purchase of an NFT grants the Buyer:

• ownership of the NFT as a digital token,

• a personal, non-commercial license to use the associated artwork,

• the right to display the artwork for personal purposes (digital galleries, collections, social media), provided the artist is credited.
   

❌ The following are strictly prohibited without prior written consent from the Seller:

• any commercial exploitation,

• reproduction for profit,

• modification or alteration of the artwork,

• use of the artwork in derivative works, products, or services.

All intellectual property rights remain exclusively with the artist.
 

5. ARTIST’S RIGHTS

The Seller retains:

• full copyright and intellectual property rights,

• the right to reproduce and display the artwork,

• the right to exhibit the artwork physically or digitally,

• the right to create variations, derivatives, or future iterations,

• the right to use the artwork for communication and promotional purposes.
   

6. PRICES

Prices are indicated:

• in cryptocurrency (ETH or other), and/or

• in fiat currency where applicable.

Blockchain-related fees (gas fees), platform fees, and transaction costs are borne by the Buyer, unless otherwise stated.

Prices may vary depending on:

• the category of the artwork,

• the format (image, video),

• rarity,

• the curatorial and artistic strategy of the Maison.
   

7. PURCHASE PROCESS

An NFT purchase becomes final once:

• the transaction is validated on the blockchain, and

• payment has been confirmed.

The Seller shall not be held responsible for:

• Buyer handling errors,

• incorrect wallet addresses,

• losses related to blockchain technology or third-party platforms.
   

8. NO RIGHT OF WITHDRAWAL

In accordance with regulations applicable to digital content supplied in an intangible form, no right of withdrawal applies once the blockchain transaction has been confirmed.
 

9. THIRD-PARTY PLATFORMS

When a sale is carried out via a third-party platform:

• the platform’s own terms and conditions apply in addition to these Terms,

• the Seller shall not be held responsible for technical failures, fees, policies, or security issues specific to such platforms.
   

10. LIABILITY

The Seller shall not be liable for:

• fluctuations in the value of NFTs,

• risks inherent to blockchain technology,

• financial losses,

• technical failures or security breaches of platforms or digital wallets.

The Buyer acknowledges purchasing NFTs with full awareness of the risks associated with blockchain technologies.
 

11. PERSONAL DATA

Any personal data collected is used solely for:

• managing sales,

• communicating with Buyers.

Such data is neither sold nor transferred to third parties.
 

12. GOVERNING LAW

These Terms are governed by French law.

In the event of a dispute, an amicable solution shall be sought prior to any legal action.

In case of discrepancy, the French version of the Terms shall prevail.
 

13. ACCEPTANCE

The purchase of an NFT implies full and unconditional acceptance of these Terms & Conditions of Sale.
